These terms apply when you buy a licence for Marley Live or use this website. Buying a licence means you accept them.

Who you are dealing with

Louis Haywood, trading as Marley Live. hello@marley.louishaywood.uk.

Before this goes live: a trading address has to appear here. Distance selling rules require a geographic address, not just an email, before a customer is bound by a purchase.

Before this goes live: confirm the VAT position. This page currently states that the seller is not registered for VAT and that no VAT is charged. If that is wrong it has to be corrected here and on the buy page, and a VAT number added.

What you are buying

A licence to use the full version of Marley Live. You are not buying the software itself, and copyright in it stays with Louis Haywood.

  • Each licence activates one Mac at a time. You can move it as often as you like by deactivating one Mac and activating another.
  • Every Mac on the same network as an activated Mac gets the full version through Crew Mode, at no extra cost. That is intended behaviour, not a loophole.
  • A licence bought outright has no expiry. A monthly subscription works for as long as it is paid for.
  • Updates are included.

What you may not do

  • Share, sell, sublicense or publish your licence key.
  • Try to defeat the licensing, or use a key you were not given.
  • Decompile or reverse engineer the app, except where the law specifically allows it.

A licence found to be shared publicly can be revoked. Any Mac already activated keeps working, because the app runs offline, but no new Mac will be able to activate.

Subscriptions

A monthly subscription renews automatically until you cancel. Cancelling takes effect at the end of the month you have already paid for, never immediately, and you can restart it any time before then from your account. If a payment fails you will be emailed before the licence stops working.

Your account

Keep your password to yourself. You are responsible for what happens under your account. If you think someone else has access, change your password and sign out everywhere from your account page.

Free version

The free version is free, has no time limit and needs no account. It is provided as it is, with no promises attached.

What is promised, and what is not

Marley Live is a measurement and monitoring tool. It is not a certified sound level meter and is not a substitute for calibrated test equipment where a legal or certified measurement is required. Accuracy depends on your microphone, your interface and your calibration, none of which are under this software's control.

You are responsible for decisions you make during a show. Nothing here limits liability for death, personal injury or fraud, or any other liability that cannot be limited by law. Beyond that, liability is limited to what you paid for the licence.

None of this affects your statutory rights as a consumer. Digital content must be of satisfactory quality, fit for purpose and as described, and if it is not, the Consumer Rights Act 2015 gives you a right to a repair, replacement or refund.

If the service stops

If this licence server were ever shut down, licences already activated would keep working, because the app does not contact the server after activation. If it is going to be shut down permanently, anyone holding a licence will be told in advance and given a way to keep using what they paid for.

Ending it

You can stop using Marley Live at any time and delete your account from your account page. A licence can be revoked for breaking these terms, or refunded under the refund policy.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK you keep the protection of your local consumer law.
